Agreement to Terms

By downloading, installing, or using the Smooth mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ProductShake LLC ("Company", "we", "our", or "us").

Age Requirement

The App is rated 17+ and is intended for adult users only. By using the App, you represent and warrant that you are at least 17 years of age. If you are under 17, you may not use the App.

Description of Service

Smooth provides AI-powered reply suggestions for dating app conversations. The App includes:

• A custom keyboard extension that analyzes screenshots
• AI-generated reply suggestions based on conversation context
• Customizable style preferences including language style, text case, and flirt level, plus a personal profile to personalize suggestions

The App requires Full Access permission for the keyboard extension to function. This permission is necessary to analyze screenshots and provide reply suggestions.

Subscriptions and Billing

Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Payment

Payment will be charged to your Apple ID account at confirmation of purchase. All payments are processed through Apple's App Store. We do not have access to your payment information.

Managing Your Subscription

You can manage or cancel your subscription at any time through your Apple ID account settings:

1. Open the Settings app on your iPhone
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "Smooth" to manage or cancel

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period. No refunds will be provided for partial subscription periods.

Refunds

All purchases are final. Refund requests must be directed to Apple through the App Store, as they process all payments. We cannot process refunds directly.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App to harass, abuse, or harm others
• Use the App to send spam, unsolicited messages, or deceptive content
• Use the App to impersonate others or misrepresent your identity
• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Share your account or subscription with others
• Use automated systems or bots to access the App

AI-Generated Content

The reply suggestions provided by the App are generated by artificial intelligence. You acknowledge and agree that:

• AI suggestions are provided as-is and may not always be appropriate
• You are solely responsible for reviewing and editing suggestions before sending
• You are responsible for all messages you choose to send
• We do not guarantee the effectiveness or appropriateness of any suggestions
• The App is a tool to assist you, not a replacement for genuine communication

Intellectual Property

The App and its original content, features, and functionality are owned by ProductShake LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will meet your specific requirements or expectations

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PRODUCTSHAKE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Our total liability to you for any claims arising from or related to the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless ProductShake LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Messages you send using suggestions from the App

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the App after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
